The newestupdate 1308 i was told to reboot, but before that Kis 2009 detected mbam setup as a trojan Generic Riskware and quarantined.
Well the same happened in my xp partition "vista/xp"dual boot i know from kis 7.0 that it was a false positive with superantispyware pro is that the same case here?

Yes, force Kaspersky to update databases if you don't have the latest yet.

I installed about 3hrs ago and had no problems with my KIS.
