Weird, I already had all those settings as you requested but it was still throwing the error even when not scanning. I was able to complete a scan with the rootkits setting off this morning so I've re-enabled realtime protection to see how it goes. Thanks for the help!

Yes, I was running rootkit scans but disabled it to no avail. It happens over night during the scans as well as randomly when not scanning during the day. It's always the MBAMSwissArmy.sys I have attached the minidump from one of the occurrences. 091916-17125-01.dmp
